The Last Will and Testament of Ada Josephine Smythe
(who, in fact, survived her husband.)

THIS IS THE LAST WILL AND TESTAMENT of me ADA JOSEPHINE SMYTHE the Wife of Frank Tompson Smythe of Spring Hill Lodge Nailsworth in the County of Gloucester _ _

I APPOINT my son Henry James Drew Smythe and my daughters Marjorie Jose Drew Fisher and Phyllis Mary Drew Tuft (hereinafter called my Trustees) to be the Executors of this my Will. I GIVE all my personal chattels to my said husband Frank Tompson Smythe absolutely AND as to all the residue of my estate and effects both real and personal I GIVE DEVISE AND BEQUEATH the same AFTER payment of all my just debts funeral and testamentary expenses and duties to my Trustees UPON TRUST to sell call in and convert the same into money with power in their discretion to postpone such sale calling in and conversion for so long as they shall think fit and to invest the proceeds thereof in such investments as they shall think fit with power to vary such investments from time to time and to pay the income of such investments and of all parts of my estate for the time being unsold and unconverted (hereinafter called my residuary estate) to my said husband Frank Tompson Smythe for his life or widowerhood and after his death or second marriage whichever shall first happen to pay and divide the capital and income of my residuary estate unto and equally between my three children the said Henry James Drew Smythe and the said Marjorie Jose Drew Fisher and the said Phyllis Mary Drew Tuft PROVIDED nevertheless that should either of my said three children die in my lifetime leaving issue living at my death such issue shall take and if more than one equally between them the share which his her or their parent would have taken if he or she had survived me IN WITNESS whereof I have hereunto set my hand this eighteenth day of July one thousand nine hundred and forty four.
