The document has been donated to these records by Fay (Todman) Neville of Western Australia. Donald Neville, her husband, was the son of Henry Thomas Neville and Sarah Anne Drew (Sally) "Sally" was the youngest child of Nias James Drew who was the son of James (Hosier) Drew and Sarah Ann Merewether Nias and the eldest brother of Ada Josephine Drew.

Sarah Ann Merriwether Drew of Enfield Lodge, Thornton Heath, Croydon in the County of Surrey died on the 3rd day of March 1913 at Enfield Lodge.

Probate was granted to Rosa Mary Drew of Enfield Lodge, spinster and daughter of the deceased, the Executrix named in the said will and the Reverend Frank Tompson Smythe of Barnclose, Nailsworth in the County of Gloucester, Baptist Minister, the Executor named in the said codicil.

This is the last Will and Testament of me SARAH ANN MEREWETHER DREW of Enfield Lodge Thornton Heath Croydon in the County of Surrey Widow I appoint my daughters Rosa Mary Drew and Catherine Maude Drew EXECUTRICES AND TRUSTEES of this my Will I bequeath to such of my daughters who shall be spinsters at my death (and if more than one to them in equal shares) all my wearing apparel plate jewellery linen china glass books pictures prints wines furniture and articles of gousehold use of every kind (except money or securities for money) which shall be in or about my dwellinghouse at the time of my decease but if I shall leave no daughter who shall be a spinster I direct that the same shall be equally divided among all my children at my decease (other than my eldest son Nias James Drew and my son William Somerset Drew) I expressly empower my Executrices to select and determine the specific articles to be taken by such legatee for his or her share under the said bequest and I declare that the decision of my Executrices as to the value of such articles and generally as to the distribution thereof shall be final and conclusive I bequeath to my said son William Somerset Drew the sum of twenty pounds I bequeath to my said daughter Catherine Maude Drew if she shall be a spinster at my decease but not otherwise the sum of two hundred pounds for her own use I devise and bequeath all the residue of my estate both real and personal unto my trustees Upon trust to sell and get in the same and divide the proceeds equally between all my children (other than the said Nias James Drew and William Somerset Drew) living at my death and the children then living who have attained or shall attain the age of twenty one years of such of them (other than the said Nias James Drew and William Somerset Drew) as shall be then dead such last named children taking only the share their parent (being a child of mine) would have taken if such parent had then been living I revoke all Wills by me at any time heretofore made IN WITNESS whereof I have hereunto set my hand this fifteenth day of June one thousand eight hundred and ninety four --------- signature S.A.M.D.------- Signed by the Testatrix as and for her last Will and testament in the presence of us who at her request in her presence and in the presence of each other all being present at the same time have hereunto subscribed our names as witnesses ------- signature AUG CHA SADLER 28 Golden Square W - Solicitor ----- signature HUGH R SADLER of the same place his clerk

THIS IS A CODICIL to the last Will and testament of me SARAH ANN MEREWETHER DREW of Enfield Lodge Thornton Heath Croydon in the County of Surrey Widow which Will id dated the fifteenth day of June one thousand eight hundred and ninety four Whereas by my said will I appointed my daughters Rosa Mary Drew and Catherine Maude Drew Executrices and Trustees thereof And whereas my said daughter Catherine Maude Drew has since married Now I hereby revoke the appointment of the said Catherine Maude Drew as such trustee and Executor and I appoint my son in law The Reverend Frank Tompson Smythe to be a TRUSTEE and EXECUTOR of my said Will in the place of the said Catherine Maude Drew and I declare that my said Will shall be construed and take effect as if the name of the said Frank Tompson Smythe were inserted in the place of the said Catherine Maude Drew and I declare that my said Will shall be construed and take effect as if the name of the said Frank Tompson Smythe were inserted in my Will throughout as one of the executors and trustees thereof instead of the name Catherine Maude Drew I empower my Executors if they shall in their absolute and uncontrolled discretion think fit to maintain and keep up for such period not exceeding three calendar months from my death as they shall deem desirable my establishment in the same manner as it was maintained and kept up by me during my lifetime and that the cost and expense thereof shall be defrayed out of my residuary estate I bequeath to my trustees the sum of five hundred pounds upon trust to invest the same in any of the securities in which monies liable to be invested under my said will or under this Codicil or any subsequent Codicil thereto may be invested and out of the income and capital thereof from time to time to pay and apply such parts of the said income and capital as my trustees shall in their absolute and uncontrolled discretion think fit in or towards the maintenance education or otherwise for the benefit of my grand daughter Ellen Jane Drew Nias (child of my daughter Ellen Jane Odell (now Nias) as my trustees shall in their absolute and uncontrolled discretion deem expedient and after the death of my said grand daughter I declare that my trustees shall hold such part of the said sum as they shall have not paid or applied for the purpose aforesaid upon similar trusts to those by my said Will and by this Codicil declared concerning the share of my daughter Ellen Jane Odell (now Nias) in the proceeds of sale of my residuary estate And whereas I have given to my daughter Ada Josephine Smythe the sum of five hundred pounds and to my daughter the said Rosa Mary Drew the sum of seven hundred and forty five pounds Now I hereby declare that the said sums but without any interest thereon shall be accounted deemed and taken as and for part of the respective shares of my said daughters of and in my residuary estate and shall be brought into account on the division of my estate And whereas by my said Will I have devised and bequeathed the residue of my estate to my trustees in my said will named upon trust to sell the same and divide the proceeds equally between all my children (other than Nias James Drew and William Somerset Drew) living at my death and the children then living who have attained or shall attain the age of twenty one years of such of them (other than the said Nias James Drew and William Somerset Drew) as shall be then dead Now I do hereby declare that if my daughter Ellen Jane Odell (now known as Ellen Jane Nias) shall be living at my death the trustees of my said will shall retain the share of my said daughter of the said proceeds upon trust to invest the same in any of the securities in which monies liable to be invested under this my Codicil may be invested and shall out of the income and capital thereof so long as the same shall last from time to time pay my said daughter such sums as and when my trustees shall in their absolute and uncontrolled discretion think fit without being liable for the application thereof until she shall assign or charge the same or some part thereof or do or suffer something whereby the same if belonging absolutely to her or some part thereof would become vested in or payable to some other person and after the happening of any of the aforesaid events in her lifetime then to pay and apply so much of the said income and capital as my trustees shall in their absolute and uncontrolled discretion think fit for the maintenance and support or otherwise for the benefit of my said daughter and all or such one or more exclusively of the children of my said daughter for the time being in such manner in such amounts and at such times as my trustees shall in their absolute and uncontrolled duscretion think fit and after her death shall pay and apply the said income and capital for the maintenance and education or otherwise for the benefit of all or such one or more exclusively of her children in such manner in such shares and proportions and at such times as my trustees shall in their absolute and uncontrolled discretion think fit with full power to pay any part or parts of the said Income and Capital to any or either of my said daughters children who shall at my death have attained or shall thereafter attain the age of twenty one years I hereby expressly authorize my trustees if the(y) shall in their absolute and uncontrolled discretion think fit not to enforce payment of any sum or sums of money and interest which may at my death be owing or shall after my death become owing from my said daughter to me on any account whatsoever with full power to my trustees to release my said daughter or her legal personal representatives from the payment of any such sum or sums of money and interest or any part thereof as they shall in their absolute and uncontrolled discretion think fit And I hereby further expressly authorize and empower my trustees if they shall in their absolute and uncontrolled discretion think fit not to include as part of my estate any sum or sums of money or interest or any part thereof owing by my said daughter to me and to release without any payment or upon payment of such sum as my trustees shall deem expedient any security held by me for any sum or sums of money owing by my said daughter to me And I further expressly declare that my trustees shall not be responsible in any way in consequence of the exercise by them of the powers by this my Codicil conferred by me upon them I declare that all monies liable to be invested under my said will or under this Codicil or any subsequent Codicil thereto may be invested in or upon any stocks funds or securities of or guaranteed by the Government of the United Kingdom or India or any British Colony or Dependency or any Foreign State or in stock of the Bank of England or the Debentures securities stocks or shares of any Company in the United Kingdom or India or any British Colony or Dependency or in the purchase or upon mortgage of freehold copyhold or leasehold property in England or Wales such leasehold property being held for a term whereof fifty years at least shall be unexpired at the time of such purchase or mortgage and that my trustees shall have full power from time to time to vary or alter the said investments
